Please read these Website and Services General Terms of Use ("General Terms") carefully before using this website (the "Site") and its services (the "Services"). Using the Site and Services indicates that you accept these General Terms. If you do not accept these General Terms, do not use the Site and Services.
If we change these General Terms, we will post the revised document here with an updated effective date. If we make significant changes to these General Terms, we may also notify you by other means such as sending an email or posting a notice on our home page.

2. Access to the Site and Services
2.1 Subject to any contractual obligations we may owe to any users of our paid services, we shall not be liable if for any reason the Site and Services are unavailable at any time or for any period.
2.2 From time to time, we may restrict access to all or some parts of the Site and Services to users who have registered with us.
2.3 If you choose, or you are provided with, a user identification code, password or any other piece of information as part of our security procedures, you must treat such information as confidential, and you must not disclose it to any third party.
2.4 We reserve the right to restrict or deny you access to all or some parts of the Site and Services if, in our opinion, you have failed to comply with these General Terms.
2.5 Jobseekers and Recruiters need to be aware that we do not introduce or supply Jobseekers to Recruiters (or vice versa). It is recommended that, if you are a Jobseeker to ensure your suitability for the role advertised and the authenticity nature of the Recruiter, if you are a Recruiter, to ensure a work-seeker's suitability for the role you should undertake the steps set out in The Conduct of Employment Agencies and Employment Business Regulations 2003.
2.6 If you are a Jobseeker by accessing our Site or using our Services you warrant that you are at least 18 years old
2.7 We try to make this Site as accessible as possible and easy to use for everyone. We are making every effort to ensure that we don't exclude any users. For example by:
- using clear and simple language;
- ensuring that text can be increased and decreased in size by the user;
- providing strong colour contrast between text and background and not using colour as a prompt or to convey information;
- ensuring that audio and video can be paused or stopped by users and have subtitles, captions or written transcripts available;
- providing alternative text for images (unless they are purely for decoration);
- making it easy to find information (search/sitemap/navigation);
- not using quick flashing (i.e., more than three flashes a second); and
- providing labels next to fields that require the user to enter information.
Also, we ensure that all documents are available in an accessible format (both Word doc and PDF versions).

3. Intellectual Property and Permitted Use
3.1 We are the owner or licensee of all intellectual property rights in the Site and the material published on it. Those works are protected by copyright laws and treaties around the world. All such rights are reserved.
3.2 The information on the site are for the sole purpose of jobseekers seeking employment opportunities and related information and for recruiters seeking candidates to fill job vacancies. You may use information (including printing and downloading content) from our Site for your personal non-commercial use only provided that:
3.2.1no documents or related graphics are modified in any way;
3.2.2no graphics are used separately from accompanying text; and
3.2.3no copyright and trade mark notices are removed.
3.3 You may not otherwise copy, display, transmit or distribute any material from the site. All copyright, database rights and other intellectual property rights in the site and the material available on the site belongs to us or our third party suppliers. Use of the site does not give you any proprietary rights in such materials. You agree not to deep-link and/or frame the Site or any of our Services for any purpose, unless specifically authorised by us.
3.4 You agree not to use the Site and Services for commercial purposes without registering with us or obtaining our prior written agreement;
3.5 Any party using this service for any purpose other than those specifically stated in these General Terms shall immediately be banned from using this site.
4. Material Submitted by You
4.1 We permit Jobseekers and Recruiters to access use and interact with our Site subject to these General Terms of Use and (if applicable) our Client Terms [link]. Any material which you submit to the Site will (subject to the exceptions set out in our Privacy and Cookie Policy [Link] be considered non-confidential and non-proprietary and will be used by us in accordance with our Privacy & Cookie Policy. You may if you submit a CV to our database, anonymise your personal details.
4.2 You agree not to submit any material:
4.2.1 that is false, misleading, defamatory, discriminatory, threatening, offensive, abusive, likely to cause someone anxiety or distress, encourages violence or racial or religious hatred, blasphemous, pornographic, in breach of confidence, in breach of privacy; or
- 4.2.2 that infringes any intellectual property rights, such as copyright and trademarks. This means generally that you must own the rights in everything you submit or must obtain permission from the rights owner to submit the material; or
- 4.2.3 which is technically harmful (including, without limitation, computer viruses, logic bombs, Trojan horses, worms, harmful components, corrupted data or other malicious software or harmful data); or
- 4.2.4 which encourages or teaches conduct that is a criminal offence, gives rise to civil liability, or is otherwise unlawful.
4.3 We are not obliged to use material submitted by you and we may remove from the Site, the Services and our database any of the material submitted by you at our sole discretion.
4.4 We will fully co-operate with any law enforcement authorities or court order requesting or directing us to disclose the identity of anyone submitting material in breach of this clause 4.
4.5 We will not be responsible, or liable to any third party, for the content or accuracy of any materials submitted by any user of our Site.
4.7 We reserve the right to offer third party services and products to you based on the preferences save where you request not to receive such offers or to unsubscribe. Such offers may be made by us or by third parties. Please see our Privacy and Cookie Policy, for further details on this.
- 4.8. If you are a Jobseeker, you acknowledge and agree that you are solely responsible for the form, content and accuracy of any CV or material contained therein placed by you on the Site. You should be aware (subject to the contact details you provide) that you may be contacted directly by Recruiters by email, post or telephone.
- 4.9 The Jobseeker must inform us directly if they are contacted by the Recruiter without intervention from us.
4.10 Jobseekers use of our Site and Jobseeker services are free.
4.11 We do not discriminate against anyone registered to or using our Site. We try to ensure that measures are taken to prevent any vacancies advertised or searches do not discriminate against age, disabilities, gender or race. The search tools in place on the site do not have the functionality to exclude any Jobseekers with disabilities. We cannot however monitor all Recruiter advertisements or their behavior. You should inform us by emailing us at support@africa-legal.com if you believe a Recruiter is not complying with discrimination laws.
4.12 Services and information provided on the site by us and our third party suppliers are intended to assist in the job seeking or recruitment process. Neither we nor our third party suppliers can guarantee their suitability or prospects of success in any particular case. You should obtain independent verification before relying on information provided on the site in circumstances which may result in loss or damage.
4.13 You understand and acknowledge that you have no ownership rights in your account and that if you cancel Your account or Your account is terminated, all your account information including CVs, Profiles, cover letters, saved jobs, questionnaires will be marked as deleted and may be deleted from our databases within a reasonable time period. Third parties may retain saved copies of your Information.
4.14We reserve the right to delete your account and all of your Information after a significant duration of inactivity or in the event that any of our terms have been breached by you.
5. Data Protection and Privacy
5.1 We use and process your personal information in accordance with our Privacy and Cookie Policy.
5.2 We hold a data protection registration and comply with data protection legislation.
6. Third Party Content and Links
6.1 We are not liable or responsible for the third party content on the Site and in the Services. Third party content includes, for example, material posted by other users of the Site and Services, industry news, job vacancy advertisements and display advertising.
6.2 Where the Site and Services contain links to other sites and resources which are provided by third parties, these links and resources are not an endorsement and provided for your information only and you access them at your own risk. We are not liable or responsible and make no representations regarding the content of third party sites or resources.
7. Our Liability
7.1 General Disclaimer
SUBJECT TO CLAUSE 7.5, UNLESS OTHERWISE EXPRESSLY STATED BY US, OUR SERVICES, RESOURCES, AND ANY CONTENT, SERVICES, OR FEATURES MADE AVAILABLE IN CONJUNCTION WITH OR THROUGH THE SERVICES OR ON THE SITE ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMISSIBLE PURSUANT TO APPLICABLE LAW, WE AND OUR AFFILIATES DISCLAIM ALL WARRANTIES, STATUTORY, EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT OF PROPRIETARY RIGHTS, CORRECTNESS, ACCURACY, AND RELIABILITY.
UNLESS OTHERWISE EXPRESSLY STATED BY US, WE AND OUR AFFILIATES DO NOT WARRANT THAT THE SERVICES AND ANY CONTENT, DATA SERVICES, OR FEATURES MADE AVAILABLE IN CONJUNCTION WITH OR THROUGH THE SERVICES WILL BE UNINTERRUPTED OR ERROR-FREE, THAT DEFECTS WILL BE CORRECTED, OR THAT THE SERVICES AND ANY CONTENT, DATA, SERVICES, OR FEATURES MADE AVAILABLE IN CONJUNCTION WITH OR THROUGH THE SERVICES OR THE SERVER THAT MAKES THEM AVAILABLE ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.
UNLESS OTHERWISE EXPRESSLY STATED BY US, WE AND OUR AFFILIATES DO NOT WARRANT OR MAKE ANY REPRESENTATIONS REGARDING THE USE OR THE RESULTS OF THE USE OF THE SITE, THE SERVICES, RESOURCES OR ANY LINKED SITES, IN TERMS OF CORRECTNESS, ACCURACY, RELIABILITY, OR OTHERWISE.
THE LAWS OF CERTAIN COUNTRIES AND STATES DO NOT ALLOW LIMITATIONS ON IMPLIED WARRANTIES OR THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES. IF THESE LAWS APPLY TO YOU, SOME OR ALL OF THE ABOVE DISCLAIMERS, EXCLUSIONS, OR LIMITATIONS MAY NOT APPLY TO YOU, AND YOU MIGHT HAVE ADDITIONAL RIGHTS.

- 7.2.1 any action you may take as a result of relying on any information/materials provided on the Site and in the Services or for any loss or damage suffered by you as a result of you taking such action; or
- 7.2.2 any dealings you have with third parties (e.g. other users or advertisers) that take place using or facilitated by the Site and Services; or
- 7.2.3 any liability for losses which are not a foreseeable or likely consequence of (i) your use of the Site and Services, or (ii) a breach by us of these General Terms.
7.3 We are not responsible if you cannot use the Site and Services properly or at all because of any event outside our control (e.g. the performance of your or our internet service provider, your browser or the internet.)
7.4 The Site and Services rely in part on software to work. Whilst we monitor the Site and Services and try to fix bugs promptly, we do not guarantee that the Site and Services will be error free, available all the time and/or free from viruses.
7.5 Notwithstanding any of the foregoing none of the exclusions or limitations in these terms are intended to limit any rights you have as a consumer and nothing in these General Terms of Use affects any liability which we may have for death or personal injury arising from our negligence, fraud or any other liability which cannot be excluded or limited by law.
8. Validity of these General Terms
If any part or provision of these General Terms is found to be unlawful or unenforceable, this shall not affect the validity of any other part or provision.
9. Applicable Law and Jurisdiction
These General Terms are governed by English law. The English courts shall have exclusive
jurisdiction over any claim brought by you arising from, or related to, use of the Site and
Services and these General Terms.
